The U.C. Davis Law Review has just published an article by Visiting Associate Professor Benjamin Plener Cover called The First Amendment Right to a Remedy. The article argues that the First Amendment right to "petition the Government for a redress of grievances" includes the limited right of a legally injured person to obtain a minimally adequate remedy from the courts.
